OIG RESPONSE

As you can see, another person who works at McFarland did sign for the restricted mail. But since McFarland state hospital is only one day (2 hours by car) away and that it was also sent on the first day of the work week, there shouldn't have been any delay in Jordan Litvak receiving the time sensitive letter. If he would have had it in his hand, I would have had an opportunity to actually intervene in my moms situation. 

Mr. Litvak claims that he just received my letter, two weeks after i sent it.

But I Googled the 614, this is what I got back. Not sure what rule book they were referencing, but I got a rule of my own now.

an appeal wasn't possible

I simply couldn't appeal my convictions due to the fact that judge Mays stated that I couldn't have my computers back if i appealed. those computers held the information that I needed to appeal and justify my actions. So I had to cop a deal or stay in jail and try to fight the conviction with no evidence or computer or even a law library to offer caselaw to support the appeal.

That situation falls under duress tolling.

I have moms tickets from jail, her medical info from the hospital and all communications from mcfarland hospital, the temporary guardial and other legal documents stored on line..

I also have the newspaper clippings of mom being taken to blessing hospital's psych unit and being released twice. That's why i took the camcorder up and the allowed me in with it. Then the doctors held me against my will in the elevator because of it and judge schuring washed their hands.

In regards to the RESTRICTED MAIL that damaged my case against the state hospital. So I ripped up a certified mail notice that came from a unknown user that was in my mailbox.

I got the letter for the final expenses for mom in the mail today. the court hearing is set for the 20th of october 2011 in springfield.

moms lawyer over there never e-mailed me about anything when i asked his secretary to have him do so.

NOTE: duker and haugh funeral services were paid $3,000 and only $1,500 was used for moms transportation back to quincy, her cremation ($1,000) and urn ($300).

So there's at least $1,500 that's unaccounted for.

I wonder what they were actually feeding my mom and how she really died. One thing that i do know is that nobody is telling me anything. It's my belief that i am more than happy to expose the truth when discovered. So how did my mom really die? Was she aware of what was really being fed to her? Funeral director's estimate

The numbers that were submitted to erin were just an estimate. Which she rubber stamped the payment to duker/haugh. There was no visitation per my instructions. Only the cremation and the urn as well as the transport of mom from peoria to quincy. Mr haugh wouldn't let me copy the estimate or let me have it for my moms expenses. He stated that the estimate was the wrong one.

After I asked her "Why" to call her, she responds with that she'll be there until 4:30. So I responded that I'll be there until 4:00.

No response from erin after that. Mom's court date was set for the 23rd of this month. The same day she passed away.

Nobody offered to send me any money so that I could come see her.

Neglect

I talked to mom this morning. She stated that the wouldn't feed her or give her any medicine. She wanted me to call wgem and wtad about nursing home abuse. I told her to call her doctor but he apparently wasn't there on sundays.

I'm just being a voice in a corrupt system.

I told kathy love that i needed money to get moms court transcripts. I called the courthouse to obtain them and they wanted $320.

Kathy stated that she called them as well and they were only $0.25 per page.

So she stood in the way of me obtaining them. Remember that I was my moms power of attorney.

Simply amazed!

It totally blows me away as to how all these people on that side of the fence got to know the real me as an individual. For instance. When I talked to Anthony over the phone for about ten minutes. He never asked me what type of person I was, what I liked to do for fun or anything else of the nature that would help someone get to know you over the phone in ten minutes.

In the letter, he did invite me to talk to him over the phone. But about what? Was it about talking about mom? or examining me from a remote distance?

That's why e-mail is so crucial in legal matters...(they all kinda know that).

He gave me a window of opportunity on the Monday after I got his letter of about 2 hours in between 12 and 3pm. It sounded like that If I didn't call in time, that I would never get another chance to talk to him (over the phone). He stated that he'd be gone the rest of the week. That's why I always ask for cell numbers and e-mail addresses (sean@heeger.org) they have mine. But some people feel that they're better and more above me I guess :)

Knowing now that the guardian ad litem has the complete story in his hands, he can see that my intent for using the money was appropriate. But the way it was presented to judges zappa and schmidt has me concerned.

The rule states that i can't threaten anyone with disciplinary action in order to gain an advantage.

I totally believe that the sheriffs department would rape my mom while she was in jail. Look at all the dirty tricks they pulled on me in my situation. If she says that she was raped with a johnny mop I believe her. I know they would take advantage of a person with a limited mental capacity based on what I've seen them do to others. Lying to me, hitting the bars and wanting to go "bare knuckle" with another loony up there were facts that support my moms claim. Her name is annie heeger pettice.

Anthony's Biased Report

Anthony's report only convey's the perceived bad stuff about me. He didn't mention my accomplishments, the fact that I'm stable or the truth about probation. It appears that I'll have to file a rules violation due to the additional fact that he used an inaccurate newspaper article to support his report. I just have to wait for the damage to transpire.

I called the hospital 2 days ago and spoke to moms doctor. He gave mom a year to live with her cancer. Then I talked to Erin and she gave mom 6 months in her current condition. It would be nice if I had more stuff in writing so there wouldn't be any confusion.

I believe they cause confusion just like henke and his horde caused the June 3rd action that took place right under my nose.

Yep, one of the good things about probation is being able to prove that I don't drink, smoke or do drugs.

Printing my journal

I thought it was kind of cute that Anthony printed out my journal a month before he wrote me the letter. You can see the bottom of the printouts give the date it was printed. I can only suspect that he's going to include more of my journal entries in his final report to the court that will reflect my knowledge of the situation and my handling of my position in these matters.

This leads me to believe that in my personal view, his neutrality is in question. It also makes me wonder if  he or someone else at his firm was the actual "legal department" that Don Henke said would contact me about my power of attorney (that was pulled from me surreptitiously on June 3rd). This also supports my suspicion of his motive to slant the report just enough to sway a decision that may be made by a presiding judge in these matters.

I think I'll start working on my summation as well as discovering who the principal attorney at the firm is as well as who their legal malpractice  insurance coverage is through.

That's the commonality between every one of my moms handelers. Each one of those professionals has an excuse for everything. They use "i wasn't sure, i just met her, i don't know, i think, probably", and other vague deniable phrases. I guess truth and actual knowledge of someone isn't a requirement for them to do their jobs.

They use "I wasn't sure - I just met her - I don't know -  I think maybe -probably", and other vague phrases that support the notion that they don't really know what's going on with moms health. But I think that know. How couldn't they not know? Mom's been with them long enough and been to the doctor many times while in their custody. From what I understand, medical records do migrate with the patient. 

I always say that the worse thing you can do, is assume that someoneelse is just as stupid as you are...

Legitimate language.

As previously stated, i can use whatever language i see fit to express myself as long as it's fact or opinion based. Or use phrases that have lost their meaning. So the best thing those earthbound humans can do is stay out of my business or they'll be stuck with me for life.

Having an online journal has an effect. Especially when the truth is on your side.

Corrections to Guardian Ad Litem's Preliminary Report

Just as a fact: I spoke to my mother yesterday as well as her doctor. She is in a septic state and she probably won't make it too much longer.

I also feel that the inaccuracies and preconditioned notions that were presented to the judge may have jeopardized my ability to obtain guardianship of mom. That inital request was made by McFarland (Don Henke and Kathy Love) and not the medical center. As Henke stated over the phone that he ordered and Kathy stated that she stopped the application for the OSG due to getting guardianship being too expensive.

•     11) Mom sent me letter and told me over the phone that she just wanted me to "take all of the money". I was concerned about telling her over the phone what I was going to do with it since I believed that the phones were being monitored. When her money was at the credit union I could have taken it out of her account anytime I wanted but I didn't. I could have used the power of attorney to do so but I wasn't sure what was going to happen and I didn't have any real reason to take it out at the time. I told her to just write me a letter stating her wishes. I just went through the motions until I received a statement FCCU showing me that the money had been transferred to McFarland. After which I got the 2 check from mom. Kathy love apparently mustn't have known, wasn't watching or was attempting to set me up for some reason (ripping my mom off) with the two checks that were voluntarily sent to me. I considered those gifts which my mother has done from time to time. Did I mention that I am her only living family member that will have anything to do with her? She's my mom.
•        13) I was set up by Kathryn Davis and her attorney Randall R. Prizy.  Judge ortbal recused himself from any further proceedings after I turned myself in. I also know David Ludwig and he is the type of person that would do that to someone.
•        16) The nurse did tell me what hospital that mom was sent to. How else would I know which one to call? I had to find out from mom where she was and she told me that the hospital that the nurses’ station. My outgoing phone records have been printed out. I did it in response to the hospital telling me that no person by that name has been admitted. I went back and forth between the Sharon health care elms and the hospital before mom called my alternate number verifying that she was indeed there and had been there since Friday the 15^th. I did call a leave a message with Anthony’s secretary telling him to check his mail and that mom was missing before I found out where she was.

•     2) I notified the states attorneys office after I told them that I would be taking a witness.  So the states attorney knew about it for 80 days before the warrant for the 2nd O.P. violation was filed by him. He was made very aware of the recording afterwards as well. The journal and evidence shows that Froman lied to the police about the recording device and the e-mail evidence shows that the recording was sent to he and froman. •          I was convicted of battery and got conditional discharge for beating up my step dad for hitting my mom and breaking her nose. They both had me arrested.
•     5) I am self-employed. Not unemployed.

•     6.) It was my right by law to do what mom asked me to do. Even if she was incapacitated completely it was illegal for Kathy to not honor it and use the deception of not knowing if there was another power of attorney. McFarland stalled long enough to get my mom moved(see letter to jordan litvak with restricted mail return receipt) and have the temporary guardian placed right under my nose on June 3rd. I wasn't notified about it until Betsy Bier mailed me the fax she received about the hearing that placed mom with a temp guardian.

•     C) She gave me funds when she wanted to. I would use them to get things for her and put fuel in my car since she lost her license.

•     D) I still believe that McFarland kept her there long enough to make sure they have the money to expense moms commitment. Her keepers had full control of her medications and a court order to force her take it. I was sent a list of medications by Kathy Love.  

•     E) I wanted to get her a lawyer so I could get her out and get her hospice care with blessing hospital. Which I felt was none of their business. It's a personal family matter and since the state is involved, this  copywritten journal was made public. It's in the interest of the public since McFarland allowed someone to be raped in their facility in 1994. With a settlement made 14 years later to a dead girls spouse ($35,000).
•         Getting to the hospital by using her funds were in 1.) in furtherance of her psychological well being and 2.) so that I could effectively keep the car up so that she would have transportation when she was released from the hospital. She has no drivers license and her car was confiscated by the police. Pretty simple and legitimate.

Note: Page nine is somewhat rhythmic and redundant in repetition to previous statements in the document that I'm responding to.

• I went voluntarily to see someone and his feedback was that there "was a lot of truth to what I was saying".

If anything was ommitted from their background check of me (kathy and don were the first to do one), it was intentional just to play me out and to call me on something if they needed a lever to pull. That's why they say to never volunteer information.

So I might just ask why they called my probation officer about the e-mail that I responded to Erin about my mom's burial arrangements. It's posted in this journal.

I told erin over the phone that I'd be the only one attending moms funeral. It's due to the fact that mom has driven everyone off because of her condition.

Jordan litvak finally replies!

I was sent a letter from litvak today. It was the same information that kathy love sent me about moms funds being transferred to the home. He didn't respond to the power of attorney issue (that was sent to him on the 18th of may) as he said he would on May 27th.  The return reciept and e-mail response shows the length of time that has transpired. He directed me to place all future communications with the home mom is being lodged in.

I'm wondering what the difference is between an executive director and a network manager. He's listed as both on the letter that was sent.

Apparently anthony didn't include the reason why i can't be with my son and why i can't get my evaluation.

Apparently Anthony didn't include the reason why I can't be with my son and why I can't get my evaluation in his preliminary report (of guardian ad litem).

He refused to give me his email address since I wasn't a client and stated that the web interface to send email to his firm (him) at rblawyers.net would be fine. He also said something about the confusion it would create if I sent e-mail directly (to his inbox).

Having an email thread (papertrail) is important. Making a substantiated claim somewhere down the line simply calls for it. But at least the screen captures from the first e-mail that I sent him and the other attorney in early June show the earliest date that communication was desired.

Having the response to that e-mail in the form of US mail indicates his lack of due diligence. He responded 40 days later.

The telephone in legal matters simply doesn't work for me because everything over the phone is hearsay and can be a race for credibility at times.

Just like everyone else, I don't trust strangers or lawyers.

Fact: Intentional Failure by an attorney to report legal misconduct is actionable and is grounds to have disciplinary action taken against them.

In my view, using my journals to get the court to form a negative opinion about me constitutes a gain. The price of my copyright is located at the top of order of persecution. ($170,000)

health gets worse

moms nurse at the hospital stated that mom was septic and that her kidneys failed. mom was refusing treatment most likely because she feels hopelessly doomed because of her situation and being kept away from me all of this time. I asked erin for some money this morning so i could get there and she said no.

it's impossibile to know what's true and what's false, due to the fact that these people are expert manipulators and are obviously in my view on a mission.

I talked to erin this morning. Told her i wanted proof of moms condition and that i didn't have much faith in what a state employee tells me. The state of illinois is corrupt as everyone knows.

update: I just talked to my moms nurse.

prelim report from g.a.l.

I received  a copy of the preliminary report from the guardian ad litem today. It has errors and  it also has this (what you're reading) and my other online journal listed in the filing. If it clears legal matters I'll post the document at a later date.

As far as my job goes, my email address is service @ neighborhoodnet.net and has been since Feb 2002. I own the domain and have been doing business off and on as NeighborhoodNET since 2002. But now I can't seem to find the company NeighborhoodNET in elgin, Il as stated in the court document (the preliminary report).  I google NeighborhoodNET, INC and for some reason it doesn't resolve. Here's the Wayback on my domain. 

The knowledge of attorney misconduct in my personal matters, now proven to be obtained by Anthony DiGiornio, will be addreses at a later time.

erin didn't know about moms situation until i told her today. she was suprised that i knew who moms doctor was up on her floor at the hospital. erin said to call her after her appointment at 10 tomorrow morning. she said 11:30 for me to call about mom. she didn't want to call mom today.

Don Henke ordered Guardianship

When I was in the library, I was speaking on the phone to Don Henke about the Power Of Attorney I had over mom. At the time when that conversation took place, mom was refusing cancer treatment. She ended up going to Memorial Hospital shortly after her court appearance here in Adams county back on May 5th. This was when she told Judge Mays in open court that she wanted to get cancer treatment.

During that phone conversation with Mr. Henke, he indicated that they were ordering Guardianship for mom. Mom was telling them the whole time that she wanted me to be her guardian.

The truth is, Memorial Hospital wasn’t the place that ordered it for mom. It was most likely Kathy Love since she had the power to do so. Even though she was being told by both of us that this isn’t what mom wanted.

So with that, Anthony D. indicated in his letter dated on the 13th of this month that Memorial ordered it, which wasn't true.

Mom went to Memorial Hospital for treatment and according to her letter, she indicated that she would be in the hospital for 7 days.

Then after her treatment at memorial, she was moved to Sharon Health care Elms and the hearing went through on the 3rd of June that appointing Erin as her temporary guardian, removing me as my mom’s power of attorney and letting me know after the fact. During this time, Jordan Litvak was suppose to reply to my mail.

My friend JR was sitting right next to me when Don and I were talking.

Just got off the phone with mom, she says that she's  okay and that she has a phone now. she said that her kidneys failed and that they kept tormenting her while she was at the home. Her throwing feces isn't true. It was just as I suspected. Lies were given to me by the staff at the home. So I gave her Tony D's (her Guardian Ad Litem) number at his office in Springfield.

Mom also called the funeral home here in Quincy (Duker -Haugh) and said that her arrangements weren't taken care of.

I also told her of the Assistant states attorney.

(Sorry, but I'm gonna believe my mom over you fucks!)
